Google Instant Infringement Chart

Dear Chris:
Please see the attached infringement chart for Google Instant. As far as we have been
able to determine, Google recently added this functionality to its web site, and certainly did so
after the date of Eolas’ initial infringement contentions. See http://www.google.com/instant/
(“Google Instant is a new search enhancement that shows results as you type.”). See also
http://technolog.msnbc.msn.com/_news/2010/09/08/5069614-google-instant-speeds-up-search.
Accordingly we have produced the attached infringement chart for Google Instant and provided
it to you as quickly as possible.
We intend to move the Court for leave to supplement our infringement contentions to
include the Google Instant chart attached hereto. Please let us know at your earliest convenience
if you oppose, and, if so, on what basis.
