Ironically, the Appellants consider the rejection of claims 31-33 in v i e w of Reed as a form of admission t h a t the Examiner's previous rejections of the claims h a v e failed to account for the organizational aspect of the p r e s e n t invention t h a t has b e e n detailed above. Nevertheless, wherein the database search system of Reed at least relates to the organization of information in a c o m p u t e r system, the Appellants respectfully s u b m i t that Reed fails to render claims 31-33 obvious. Reed discloses a database search system that retrieves "multimedia information." (Reed, the Abstract). The stated novelty of Reed is the p r o v i s i o n of multiple "textual e n t r y paths" for searching textual information a n d "multiple graphical e n t r y paths" for searching graphical information "such t h a t the search system retrieves information t h r o u g h b o t h textual and graphical e n t r y paths." (Reed, col. 3, line 64 to col. 4, line 2). More specifically, a total of eight textual a n d graphical e n t r y p a t h s are p r o v i d e d (Idea Search 30, Title Finder 40, Picture Explorer 50, Topic Tree 60, Feature Articles 70, World Atlas 80, History Timeline 90, a n d Researcher's Assistant 100), and the eight e n t r y p a t h s are accessible to the user via a Main Menu p r o g r a m 10. (Reed, col. 6, lines 48-65; Figure 1 of the Drawings). Figure 23 of Reed, which is not discussed a n y w h e r e in the detailed description of Reed, is described in the Brief Description of the Drawings section as "a p l a n view of the search system and related hardware," a p p e a r s to s h o w a display m e n u generated by the Main Menu p r o g r a m 10 w h e r e i n a p o r t i o n of the "main menu" display is designated to each of the eight e n t r y paths. (Reed, Figure 23 of the Drawings). Selecting an entry p a t h from the m a i n m e n u "activates the d e s i g n a t e d function or e n t r y p a t h program. (Reed, col. 7, lines 64-68). Figures 322 of Reed are flow charts detailing the logic operations of the various p r o g r a m s a n d functions t h a t may be invoked from the main menu. (Reed, Brief Description of the Drawings). I n his a t t e m p t to s t r e t c h the teachings of Reed a r o u n d claim 31, t h e

E x a m i n e r w a s forced b o t h to p a r a p h r a s e the recited claim l i m i t a t i o n s a n d to m i s c h a r a c t e r i z e w h a t Reed actually discloses s u c h t h a t the E x a m i n e r c o u l d i g n o r e the r e c i t e d limitations of the claims a n d the insufficiency of Reed. For e x a m p l e , t h e E x a m i n e r h a s relied on F i g u r e 23 a n d the A b s t r a c t as disclosing the r e c i t e d "displaying" s t e p s of claim 23. H o w e v e r , the specification of Reed m a k e s clear t h a t the " m a i n m e n u " a n d c o m p o n e n t sections s h o w n t h e r e i n by F i g u r e 23 r e p r e s e n t functions or p r o g r a m s t h a t the u s e r m a y i n v o k e b y selection ( a p p a r e n t l y b y " p o i n t i n g a n d clicking), n o t d o c u m e n t s or collections of d o c u m e n t s , as a s s e r t e d by the Examiner. F u r t h e r m o r e , the Examiner h a s a s s e r t e d t h a t F i g u r e s 4, 5, a n d 8 of Reed s h o w the r e c i t e d "creating" s t e p w i t h the exception t h a t Reed fails to disclose the use of a s a m p l e d o c u m e n t . search is completed, a list of related articles (if any) is d i s p l a y e d by the system. (Reed, col. 11; Figure 5 of the Drawings). Figure 8 is merely a flow c h a r t t h a t s h o w s the logical operation of the "Tools" function of Reed t h a t enables a u s e r w h o does n o t u n d e r s t a n d w o r d in an article t h a t he is r e a d i n g to invoke a Glossary function 360 or a Dictionary function 390. The Tools function of Reed also allows the u s e r to invike a "Find-a-Word" function t h a t finds the next occurrence of a user-specified w o r d w i t h i n the article t h a t the user is c u r r e n t l y reading. The Appellants s u b m i t t h a t a list is an example of a textual r e p r e s e n t a t i o n of the f o u n d articles, and the list of documents found by the search do n o t form a "collection of documents" as recited by the claims and defined by the specification of the p r e s e n t application. Instead, the list of d o c u m e n t s of Reed merely p r o v i d e s a mechanism for retrieving relevant articles, and t h e r e is no indication t h a t forming a list by the Idea Search entry p a t h alters the organizational relationship between the f o u n d articles w i t h i n the filing s y s t e m of the c o m p u t e r system of Reed. In fact, the list of Reed is more p r o p e r l y t e r m e d an "alias" or p o i n t e r for allowing access to found articles. (Reed, col. 9, lines 22-26). The Examiner has further asserted t h a t Figure 8 s h o w s "automatically u s i n g a w o r d from a predefined document, i.e. contents, for searching o t h e r documents." (Final Office Action, p a g e 12). The Appellants note t h a t Figure 8 is merely a flow c h a r t t h a t shows the logical operation of the "Tools" function of Reed t h a t enables a u s e r to invoke a n u m b e r of functions w h i l e v i e w i n g an article, w h e r e i n all of the functions, including Glossary, Bookmark, and Dictionary, are related to the article the u s e r is viewing. The fact t h a t the Dictionary function allows a user to click on a w o r d in the article t h a t the u s e r is v i e w i n g in o r d e r to p e r f o r m a dictionary look-up is irrelevant to the claimed invention, a n d the Examiner has p r o v i d e d no guidance as to w h e r e in Reed t h a t Serial No. 08/287,108 Examiner: A. it is s h o w n t h a t the Dictionary function s o m e h o w s h o w s the c r e a t i o n of a collection of d o c u m e n t s . Therefore, Reed fails to disclose teach or s u g g e s t claim 31 of t h e p r e s e n t application. Claims 32 a n d 33 d e p e n d from claim 31 a n d i n c o r p o r a t e t h e s a m e l i m i t a t i o n s t h a t are n o t to be f o u n d a n y w h e r e in Reed. C l a i m 32 recites the further limitation of v i e w i n g a d o c u m e n t by d i s p l a y i n g an indicia of the d o c u m e n t in r e s p o n s e to selecting the d o c u m e n t from the g r a p h i c a l r e p r e s e n t a t i o n of the collection. As Reed discloses a t e x t u a l list of r e l a t e d articles, Reed fails to disclose a g r a p h i c a l r e p r e s e n t a t i o n , a n d t h e s t e p of claim 32 is n o t t a u g h t or s u g g e s t e d by Reed. C l a i m 33 recites the f u r t h e r limitation of creating a r e p r e s e n t a t i o n of t h e collection b a s e d on an i n t e r n a l r e p r e s e n t a t i o n of the first (sample) d o c u m e n t . Reed c o n t a i n s no disclosure relating to i n t e r n a l r e p r e s e n t a t i o n s or collective i n t e r n a l r e p r e s e n t a t i o n s as d e f i n e d by the specification of the p r e s e n t a p p l i c a t i o n a n d recited in claim 33. Therefore, claim 33 is not t a u g h t or s u g g e s t e d b y Reed. The Examiner's application of Reed to claims 31-33 can o n l y be the r e s u l t of i m p e r m i s s i b l e h i n d s i g h t w h e r e i n the Examiner has u s e d the claims of the p r e s e n t a p p l i c a t i o n as a b l u e p r i n t for his rejection. As s t a t e d a b o v e w i t h r e s p e c t to the rejection of the claims in view of Levine a n d Vale, s u c h h i n d s i g h t is improper.

E. CLAIMS 81-86 ARE SUFFICIENTLY DEFINITE FOR THE P U R P O S E S OF 35 U . S . c . § 112, S E C O N D PARAGRAPH.
